Council Review Duties and Responsibilities

At the Mountain View County organizational meeting, County Councillors accepted as information a memorandum from CAO Jeff Holmes outlining the general duties and responsibilities of Councillors, and Council liability.

According to the provincial Municipal Government Act, the municipal CAO must ensure that “The Council is advised in writing of its legislative responsibilities under this Act.” Mountain View County Council achieves this purpose annually during the organizational meeting.

The following are the general duties as outlined by the Provincial Government through the Municipal Government Act (Sec. 153).

General duties of Councillors:

  1. Councillors have the following duties:
    1. To consider the welfare and interests of the municipality as a whole and to bring to Council’s attention anything that would promote the welfare or interests of the municipality;
      1. To promote an integrated and strategic approach to intermunicipal land use planning and service delivery with neighbouring municipalities;
    2. To participate generally in developing and evaluating the policies and programs of the municipality;
    3. To participate in Council meetings and Council committee meetings and meetings of other bodies to which they are appointed by Council;
    4. To obtain information about the operation or administration of the municipality from the Chief Administrative Officer or a person designated by the Chief Administrative Officer.
    5. To keep in confidence matters discussed in private at a Council or Council committee meeting until discussed at a meeting held in public;
      1. To adhere to the code of conduct established by the Council under section 146.1(1);
    6. To perform any other duty or function imposed on Councillors by this or any other enactment or by the Council.

Protection from liability (Sec. 535 of the Alberta MGA)

  1. Councillors, Council committee members, municipal officers and volunteer workers are not liable for loss or damage caused by anything said or done or omitted to be done in good faith in the performance or intended performance of their functions, duties or powers under this Act or any other enactment.
  2. Subsection (2) is not a defence if the cause of action is defamation.

Councillors also received as information the Council Code of Conduct Bylaw, a set of rules and regulations that every Councillor signs upon swearing in as a member of Council.
